The WA Department of Training and Workforce Development has advised of status changes to the Western Australian Skilled Migration Occupation List which are as follows:
Available = occupation is available for nomination
Restricted = occupation is under review and invitations will not be issued pending the outcome of the review
Closed = occupation is closed for invitations

The following occupations on the Western Australian skilled migration occupation list 2013-14 are now restricted:

Immigration to Australia is actually based on Australia Points System that describes that the persons who are eager and keen to visit Australia so, before they have to qualify few of the important perquisites where you need to score some points and those points are based on the abilities of your skills and knowledge. From 1 July 2012 there are some changes in points for Australian immigration and the new immigration points system are basically emphasized on the work experience as well as higher academic qualifications.

On other hands these points will be also applicable for study in Australia, regional study, spouses’ skills or proficiency and community languages also. The new points are will be applied on:
1.Subclass 189 Skilled Independent.
2.Subclass 190 Skilled Nominated.
3.Subclass 489 Skilled Provisional.

Another important announcement for our new and noteworthy changes in points tests that the people who are between the aged from 46 to 49 only they can apply while, the applicants can never obtain the points if they belong to the aged of between 45 to 49.

Age based points are followed as:

 1.Age from 18 to 24 years old -25 Points.
2.Age from 25 to 32 years old – 30 Points.
3.Age from 33 to 39 years old – 25 Points.
4.Age from 40 to 44 years old – 15 Points.
5.Age from 45 to 49 years old – 0 Points.

 On the base of English language proficiency

 Besides, the points also need to attain for English language proficiency, which includes minimum of 6 points scores that will be on every of the four essential factors of the International English Language Testing System (IELTS). The points should be accomplished for English Language Proficiency that includes:

1.Proficient English (need to score minimum 7 on every of the four basic factors of the IELTS) – 10 points.
2.Superior English (need to score minimum 8 on every of the four basic factors of the IELTS) – 20 points.

For Educational Qualifications

 1.For Doctorate or PhD degree if you want to do from any Australian educational universities  – 20 points.

 2.Bachelor degree and Honours bachelor or master degree from any Australian educational universities – 15 points.

 3.Diploma courses and any trade educations done in Australia – 10 points.
For skilled employment who are in Australia:

 1.Minimum one year but not more than two years (from past 10 years) – 5 points.

 2.Minimum three but not more than four years (from past 10 years) – 10 points.

 3.Minimum five but not more than seven years (from past 10 years) – 15 points.

 4.Minimum eight but not more till 9 years ( from past 10 years) – 20 points.
For skilled employment who are outside of Australia

 1.Minimum three years but not more than four years (from past 10 years)  – 5 points.

 2.Minimum five years but not more than seven years (from past 10 years) – 10 points.

3.Minimum eight years but till 10 years (from past 10 years) – 15 points.

1. Spouse visa-Those who can apply under the Spouse category are people who are married or in a de facto relationship with their sponsor. The sponsor must be an Australian citizen, Australian permanent resident or eligible New Zealand citizen. (If applying on the basis of a de facto relationship, you should have been in the relationship for at least 12 months at the time you apply).

2. Prospective Marriage (Fiancé(e)) visa-Those who can apply under the prospective marriage (fiancé(e)) category must be outside Australia, be engaged to their sponsor, and plan to marry. The sponsor must be an Australian citizen, Australian permanent resident or eligible New Zealand citizen.

3. Interdependency visa-Interdependent relationships include, but are not restricted to, same-sex couples. Those who can apply under the interdependent partner category must be at least 18 years old and in an interdependent relationship with their sponsor. The sponsor must be at least 18 years old and plan to marry. The sponsor must be an Australian citizen, Australian permanent resident or eligible New Zealand citizen.

The no further stay condition

Many Australian visas are issued with a certain condition known as the no further stay condition.

For some visas the no further stay condition is mandatory, that is, it must be imposed on the visa and the Department of Immigration and Citizenship (DIAC) decision maker has no discretion to not impose the no further stay condition.

For other visas the DIAC decision-maker has the discretion whether or not to impose the no further stay condition on the particular visa being applied for.


What is the no further stay condition?

The most common is known as Condition 8503 and it is found in the Migration Regulations.Condition 8503 provides that whilst in Australia a holder of a particular visa with this condition attached to it cannot apply for another visa.

As stated in some instances the imposition of this condition is mandatory, and in others it is totally discretionary. In the case of an Australian sponsored visitor visa (subclass 679) this condition is mandatory and must be imposed by the decision-maker, whereas with an Australian tourist visa (subclass 676) the decision-maker does have the discretion to impose the condition.


What that means…

In the case of a tourist visa, a decision-maker may impose the no further stay condition where they have some residual concerns that the visa applicant is not intending to visit Australia as a genuine visitor only, yet there is not enough evidence to suggest this assumption. The consequence of having the no further stay condition attached to a visa, is that the holder cannot apply for any other visa whilst they are in Australia, except for a protection visa. The holder must depart Australia in order to first apply for another visa.

A clear example of how the no further stay condition works is as follows. If person arrived in Australia on a sponsored family visitor visa, as stated, the no further stay condition must be applied to their visa. This means that they would be prevented for applying for an onshore partner visa, and must leave Australia to apply for an offshore partner visa.


Of course in any event they would still need to satisfy the primary criteria for the successful grant of a partner visa in any event.
